General Terms and conditions for beIN Stream
These General Terms and Conditions define the conditions for the provision of beIN Steam service by beIN Middle East and North Africa W.L.L (herein “beIN”, “we”, “our”, “ours”) to you. By activating or using our Services (“Commencement Date”), you agree to be bound by these General Terms and Conditions. Please read these General Terms and Conditions carefully.
1. Definitions
Address: means the address of your private residence in the Territory which you have notified to us.
Content : all material, channels and programmes (including any advertisements therein), and all content (whether visual, audio, video or otherwise) contained in or made available through beIN Stream Package.
Equipment or beIN Stream Box: the specific beIN hardware provided to you under your Package to receive the Service by connecting directly to beIN Cloud services over the internet via the end user’s wi-fi connection.
General Terms and Conditions or Contract: these terms and conditions as we may amend from time to time or as otherwise varied or added to by the terms of any special offer we may grant to you or any additional service you may elect to take from beIN and as otherwise set out below.
Package or beIN Stream Package: the beIN STREAM package you have selected to watch our Content.
Payment Option: a current, valid, accepted method of payment, as may be updated from time to time, and which may include payment through your account with a third party.
Price List: this document includes all of the offers and prices charged by beIN for the Subscription and available via our WhatsApp support service +974 4004 8008.
Subscriber or you: The person that enters into an agreement with beIN to receive and pay for the Service.
Subscription: subscription to beIN Stream Package.
Service(s): include the services we provide to you under this Contract and all the other associated services that beIN may make available to you as a beIN subscriber including but not limited to the creation of a beIN STREAM account to access the Package elected by you.
Territory: means the country where the Subscription was purchased.
2. Purpose
(a) We shall provide you with the Services subject to the General Terms and Conditions of this Contract. To use the Services, you must have internet access via wi-fi, a beIN Stream Box, and provide us with a Payment Option.
3. Subscription Payments
(a) You agree to pay the fees for provision of the Service, in accordance with the applicable Price List and Subscription period. The length of your Subscription cycle will depend on the type of Subscription plan that you choose when you signed-up for the Services.
(b) If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not cancel your account, we may suspend your access to the Services until we have successfully charged a valid Payment Option.
(c) You authorize us to alter your credit card or direct debit instructions if your subscription payments change for any reason upon your request. Additionally, you authorize us to charge any other payments due under these General Terms and Conditions (including any amounts due) under your credit card or direct debit instruction together with any other payments, which you agree that we may charge under that instruction from time to time during the Term.
(d) Where your Payment Option is credit card you undertake and agree to maintain at all times throughout the Term the validity of such credit card and the authority for beIN to collect the payments due hereunder. You agree to notify us immediately if the credit card provided to beIN expires, terminates or otherwise becomes invalid whereupon you shall immediately provide us with a valid and authorized replacement credit card number, together with expiry date and issuing bank name from which we shall be authorized to collect the Subscription Payments due hereunder.
(e) Where your Payment Option is credit card, you hereby authorize beIN to directly contact the issuing bank for your credit card from time to time during the Term and request, and you hereby authorize and agree, that the issuing bank for your credit card shall directly provide beIN with your credit card number (and any replacement credit card number) together with expiry date.
(f) Where your Payment Option is direct debit from your bank account, you agree not to close your bank account during the Term. Without prejudice to the foregoing, in the event that your bank account is closed during the Term you hereby authorize beIN to directly contact your bank from time to time during the Term and request, and you hereby authorize and agree, that your bank shall directly provide beIN with any other bank account number in your name which you agree shall be used in substitution for the previous bank account number for the direct debit payment authorizations made by you in this Contract.
(g) In the event that you choose to cancel your Services at any stage, the cancellation will take effect in accordance with your Subscription plan. You shall not be entitled to any refund under any circumstance. We may charge you for any due payment for the Services in accordance with your Subscription plan.
4. beIN Stream Package
(a) beIN Stream Package allows Subscribers to access to beIN Content as part of the selected Package via beIN Stream Box. Package details are described in our website www.bein.com/en/stream/support.
(b) Subscription to the Service is subject to specific technical eligibility conditions. Prior to subscribing to the Service, you must ensure that you have a reliable wi-fi connection at his own cost. The Equipment cannot support a proxy setup to an Internet connection. It can only support a direct connection with a wi-fi network, such as home network.
(c) Access to the Service is subject to the use of the Equipment as supplied by beIN. The Equipment must be connected to a main supply and a suitable wi-fi connection and be in stand-by mode when not in use.
(d) beIN Stream Package involves personal use. You undertake to use the Service for non-commercial purposes and in good faith. You can only use the Equipment at your Address and you must only use it for private viewing purposes. You must not use it in a hotel, airport, motel or other licensed premises, club, office, retail premise or similar place. Any unauthorized use outside the purpose of this Contract will result in legal liability.
You may not transfer, hire out, lend or otherwise hand over the beIN STREAM Box. You are responsible for ensuring that the beIN STREAM Box provided is kept securely, used carefully and only in accordance with beIN instructions.
(e) beIN STREAM Box must not be used outside the Territory. Any change of Address must be notified to beIN immediately. You must not tamper with beIN STREAM Box or use the Equipment for anything we do not authorize.
(f) If we believe you are using the beIN STREAM Box in any way which we have not authorized or if it is necessary to protect the security of our conditional access system, we may suspend the use of beIN STREAM Box without prior notice to you.
(g) You acknowledge that, any beIN STREAM Box we lease to you, is for your exclusive use only for purposes of using the Services during your subscription and remains beIN’s property.
(h) The Equipment provided by beIN is and at all times shall remain the sole and exclusive personal property of beIN. Upon termination of any Services, subject to any applicable laws or regulations, beIN may, but shall not be obligated to, request you to return the Equipment and in good condition. Failing to return Equipment(s) made available or in the event of late return or Equipment in poor condition, beIN reserves to right to invoice you for the value of the Equipment(s) in question indicated at the amounts indicated in the Price List.
5. Warranty
(a) The Equipment is guaranteed for a period of one year from purchase. In the event of a breakdown or defect, the defective Equipment will be replaced.
(b) The warranty does not apply in the event of deterioration resulting from a cause unrelated to the device, in the event of misuse, technical intervention, degradation, transformation or modification, defective installation and more generally in the event of use not in accordance with the recommendations appearing in the instructions for use of the above equipment. You undertake not to intervene and not to involve a third party for the purpose of repairing, modifying or dismantling of Equipment. The warranty does not cover normal wear and lack of maintenance, fortuitous events or force majeure. In the event of disappearance, loss, destruction, breakdown or malfunction of the Equipment, beIN reserves the right to invoice you for repair or replacement fees at the price set out in the current Price List.
6. Your Package
(a) The programs that we provide as part of your Package are primarily supplied by third parties and their availability is outside our control. Consequently, beIN accepts no responsibility for the Content of such programs and we reserve the right to modify, withdraw or replace any Content or advertised programs. The beIN STREAM Box only allows viewing of channels included in your specific beIN STREAM Package. Free-to-air channels are not accessible via this Service.
(b) If you elect to change your Package, for instance to add an additional content via our Video-On-Demand (VOD) service and we permit you to do so, you agree to immediately pay the price for such additional PPV Package.
(c) beIN Stream Equipment cannot be used for any other package than beIN Stream Package.
(d) We may provide you access to beIN CONNECT in addition to your beIN Stream Package. Content within beIN CONNECT may differ from beIN Stream Package.
(e) We may make special promotional offers from time to time during the Term. These special promotional offers may not be used in conjunction with any other offer from beIN. beIN reserves the right to amend/cancel any special promotional offers for any reason. beIN is not obligated to offer the same special promotional offers at the time of recharge. Others terms and conditions may apply to such offer.
7. Our Liability
(a) beIN will use its best efforts to provide a quality and continuous Services to you and remedy any defect (including repairs or replacement, as applicable) that may occur related to the provision of the Service. The Service is provided “as is” and without warranty or condition. In particular, our service may not be uninterrupted or error-free. You waive all special, indirect and consequential damages against us. Should this happen, beIN commits to the warranty as detailed in clause 5. The foregoing does not affect any liability that We cannot exclude or limit under the applicable law.
For the avoidance of doubt, beIN shall not be liable for (i) any fault in any of the Equipment caused by your tampering with it, your negligence or failure to follow our instructions (ii) our failure to provide the Service caused by events outside our reasonable control (iii) First Time Installation (FTI) done by You and/or any third parties. For the avoidance of doubts, you are not entitled to any refund in case of any interruption in beIN Services outside its control.
The foregoing does not affect any liability that we cannot exclude or limit under the applicable law.
8. Copyright
(a) beIN Service, the Equipment as well as all the elements and content attached to it, made available or represented, in any way whatsoever, in particular, and without this list being exhaustive, the programs, data, services, texts, trademarks, logos, names, software and technical tools, databases, designs and models are protected by intellectual property law and are subject to the laws and regulations applicable in the matter (designated together the “beIN IP”). beIN holds the intellectual property rights relating to the beIN IP or has obtained a regular license from their respective owner. The use of and access to the beIN IP does not confer you any intellectual property rights over any element whatsoever of the Contents, which remain the property of their respective owners.
(b) You must not and you may not assist anyone to, or attempt to, reverse engineer, decompile, disassemble, adapt, modify, copy, distribute copies, download or attempt in IP spoofing /hacking to access the service or to reproduce, lend, hire, rent, perform, sub-license, make available to the public, create derivative works from, broadcast, commercially exploit, transmit or relay any part of the programs or Content provided to you as part of the Services. You may only use the Service for private use and it must not be accessible by the general public or in a communal viewing area.
(c) You may not directly or indirectly charge others for accessing, viewing or listening to any of the of the programs or Content provided to you as part of the Services, or commercialize or attempt to re-sell the programs or Content provided to you as part of the Services in any way, which includes advertising or selling any goods and services which offer the programs or Content provided to you as part of the Services including any third party software application.
(d) The beIN STREAM BOX is embedded with a unique identification number that we can use to identify any unauthorized use of the Service or illegal copying of programming or Content. In the event that the beIN STREAM BOX identification number is identified as the source of any illegal copying or being used for reception which is not authorized of programming or Content delivered to you under the Services, we shall be authorized without notice to (i) suspend and/or terminate this Contract; and (ii) shall co-operate with including by providing your details and your Address to any owner/licensor of copyright in the illegally copied program or Content for the purpose of prosecution of such offence
(e) Any breach of this clause may infringe the copyright of third parties in the programs and Content provided as part of the Service. You will be responsible for any claims made against us for losses we may suffer as a result of actual or claimed copyright infringement committed by you or any other person using the Equipment or your beIN account in relation to the Services, for which you hereby indemnify to the full extent of such losses.
9. Parental Guidance
You must be at least 18 years of age, or the age of majority in your province, territory or country, to become a member of the Service. Minors may only use the service under the supervision of an adult. The content of the Service you have chosen may contain content you consider indecent, objectionable or offensive, or which may not be suitable for young audiences. If you permit a child to use your device to access, view or listen to the content of your Service you are solely responsible for deciding whether or not that content is appropriate for that child to view and beIN shall not be liable for that decision. This clause pertains to use of all Services provided by beIN on all devices that it may be available on pursuant to your Subscription Services.
You agree that the use of our Services, including but not limited to the viewing of Packages, creation and use of the Sub Accounts shall be your responsibility and shall be subject to these General Terms and Conditions.
10. Data Protection and Privacy
When using and accessing the Services, beIN may collect and process personal data about you. To find out more about how beIN processes your personal data, please consult our Privacy Policy.
11. Changes and Additional Conditions
(a) We may vary this Contract reasonably at any time. We may change our Subscription plans and the Price List of our service from time to time. We will notify you at least 30 days by email before any price changes to your subscription plan will become effective. If you do not wish to accept the price change or change to your subscription plan, you can cancel your membership before the change takes effect without any additional costs. You are responsible for periodically reviewing this Contract for updates and amendments. By continuing to use the beIN Steam Package, you will be deemed to have agreed to and accepted any amendments.
(b) beIN Services are constantly evolving and will change over time. We reserve the right to make such changes or, if necessary, discontinue any beIN Services subject to a 30 days prior notice. If required by law, we may also need to suspend, restrict, or terminate your access to beIN Services. In the event of beIN Services discontinuation, beIN will provide either a pro-rata refund of prepaid fees for the unused portion of the subscription period, excluding the cost of the beIN STREAM box and any Video On Demand content purchased, or offer equivalent services or benefits of comparable value, at beIN’s sole discretion. Please note that the beIN STREAM box is non-refundable. Upon discontinuation, the box will be rendered inoperable with respect to beIN services. All VOD purchases are also final and non-refundable.
12. Transfer of Agreement
(a) beIN reserves the right to partly or wholly transfer the rights under this Contract to a third party.
(b) The Contract is concluded intuitu personae. You are prohibited from assigning it, transmitting it or marketing it to a third party in any form whatsoever. You may not transfer your rights or obligations under this Contract to any third party.
13. Cancellation/Termination/Renewal/Refunds
(a) This Contract is valid until the end of your selected Subscription period and may not be subject to early termination by you (except in the event of automatic renewal). By signing up for a Subscription, you agreed that your subscription may be automatically renewed, depending on your beIN Steam Package, and, unless you cancel your Subscription, you authorized us to charge your Payment Option for the renewal. When a Subscription is canceled, you will not receive a prorated refund, but you will continue to have access to the Service until the end of the term during which you canceled the Subscription.
(b) We shall not refund any Subscription payments or other payments made under this contract if this Contract is suspended or terminated by us due to your breach of any of the General Terms and Conditions.
(c) If your access to the Service is not renewed in accordance with the above paragraph, then access will be automatically disabled until you have paid the applicable fees.
14. Piracy
(a) You undertake to use and access beIN Services in accordance with these Term, not to hinder the proper functioning of the Services in any way whatsoever, not to infringe the rights of beIN or third parties in any way whatsoever, not to infringe the law and regulations in force as well as public order and morality. In particular, you undertake, in the context of the use of and access to the Service, not to (i) violate the intellectual property rights of beIN or its licensors; (ii) circumvent technical protection systems, carry out or incite acts of piracy, transmit viruses, interrupt, destroy or limit the functionalities of the Equipment.
(b) Notwithstanding anything contained in this Contract, beIN shall be entitled, at all times, to employ such measures for the detection of piracy and/or other unlawful activities with respect to the Service. You acknowledge that the provision of unauthorized access to beIN Content through card sharing or beIN Account sharing or any other means is an illegal act that causes beIN considerable damage.
(c) We may terminate the Services and you indemnify us against any cost, expense (including legal expense we actually incur to enforce this Agreement), damage, injury, loss (including loss of revenue), liability, claim, action, or proceeding if you copy any of the Content to re-transmit them later, or for any reason due to piracy.
(d) In the event beIN terminates your access to beIN Services due to piracy, beIN will remain authorized to charge your credit card for the balance of the subscription payment due for the remainder of the Term, which you agree is reasonable. Under no circumstances will you be refunded if your Service is terminated due to your engagement in the unauthorized access/distribution of beIN Content. In addition, beIN reserves the right to seek reasonable compensation equivalent to a minimum of $2,000 for damages incurred from the result of each piracy act directly linked to your account or actions, including automatic charges to your credit card to recoup compensation for the redistribution of beIN’s content, encryption keys or any copyrighted material, such amount being a pre-estimate of the losses beIN has suffered as a result of your piracy act.
(e) beIN reserves the right to refer you to the relevant authorities for criminal prosecution, , in accordance with the law or to take any other action that is legally available to compensate beIN for your illegal actions.
15. Law
This Contract and any dispute or claim arising out of or in connection with it is the governed and shall be construed in accordance with the laws of the State of Qatar.
16. General
We may update the Contract from time to time, and may change the content of the beIN terms and conditions at any time. If there is any inconsistency, the latest version of general terms and conditions in the website shall prevail.
